
I. Sprachdimensionen
Wahl der Sprache je nach Adressat
Wir müssen uns gewöhnen:
- an die Sprache der Gesetzgebung, wie beispielsweise das Europäische Patentübereinkommen | EPÜ (European Patent Convention | EPC) und Vertrag über die internationale Zusammenarbeit auf dem Gebiet des Patentwesens (Patent Cooperation Treaty | PCT)
- die Sprache der Ämter, wie etwa das Europäische Patentamt | EPA (European Patent Office | EPO) und die Weltorganisation für Geistiges Eigentum (World Intellectual Property Organization | WIPO)
- die Sprache unserer Mandanten, die eben keine Gesetze, Ämter oder Gerichte sind und deren Sprache befremdlich finden.
Insbesondere der Wechsel von der Amts- zur Mandantenkorrespondenz kann nicht gelingen, wenn man trocken und verklausuliert verharrt, wie man es beim Entwerfen von Schriftsätzen, Einsprüchen und Stellungnahmen ist.
II. Schutzrechte
Die verschiedenen Arten von Schutzrechten
Hier eine kurze Beschreibung:
- patents are concerned with technical and functional aspects of inventions;
- utility models protect technical innovations which might not qualify for a patent, and can be protected in some countries through registration;
- copyright protects creations such as literary text, musical compositions and works of art, broadcasts and computer software against unauthorised copying and certain other uses;
- trade marks allow brands of products or services to be distinguished. They may be made up of two- or three-dimensional signs such as letters, numbers, words, shapes, logos or pictures, or even sounds;
- designs and models protect the visual appearance of industrial products, i.e. the shape and colour.
III. Patente
Eigenschaften von Patenten
Patents protect technical inventions. They are valid in individual countries, for a specified period. Patents confer the right to prevent third parties from exploiting an invention for commercial purposes without authorisation. In return, applicants must fully disclose their invention. Patents are granted and published, which makes them a prime source of technical information. The owner of a patent can exploit the invention himself, or permit someone else to do so by granting a licence, allowing the licensee to use the invention in return for some form of financial reward. This may be a one-off payment or a royalty on sales of a product incorporating the patented technology.

Voraussetzungen für Patente
Kommen wir nun zu den Big 3, die Sie natürlich kennen, wenn Sie in diesem Gebiet unterwegs sind:
To be patentable, an invention must be new (1) , involve an inventive step (2) , and be industrially applicable (3) . An invention meets these requirements if it was not known to the public before, was not obvious to a skilled person and can be manufactured or used industrially.
Bestandteile einer Europäischen Patentanmeldung
Eine Europäische Patentanmeldung (patent application) besteht aus:
- a request for grant (Antrag)
- a description of the invention (Beschreibung)
- one or more claims (Ansprüche)
- any drawings referred to in the description or the claims (Zeichnungen)
- an abstract (Zusammenfassung)
1. Ansprüche
Besonderheiten der Patentansprüche
Normally, a claim is something you demand or say. In patent applications, claims define the subject-matter for which patent protection is sought in terms of its technical features. They must be clear and concise and be supported by the description. For example:
Claim: A system comprising a remote controller, a touch screen, a processing unit, and a communication interface for sending the touch input data to a remotely controlled device, and receiving information from the remotely controlled device via a bidirectional communication protocol informing the remote controller to display a keyboard, wherein the remote controller is configured to display a keyboard on the touch screen, at least partially in response to the information received via the bidirectional communication protocol.
Das ist natürlich sehr technisch, und im Grunde genommen interessiert uns hier vor allem die Mehrfachbedeutung des Wortes claim, zum einen im IP-Kontext, zum anderen außerhalb des Patentrechts.
Mögliche Ansprüche
Once the patent enjoys protection, there can also be infringement claims. When someone uses or steals your ideas, you may have a claim for damages and other remedies, including:
- disclosure (Auskunft)
- cease and desist (Unterlassung)
- rendering of accounts (Rechnungslegung)
- recall (Widerruf)
- delivery up (Herausgabe)
- destruction (Vernichtung)
2. Erteilungsverfahren
Begriffe zum Erteilungsverfahren
Some terms from the grant procedure:

The EPO request form also contains these terms: The applicant has a representative who must submit their (general) authorisation. The inventor and the contracting states must be designated (named), a declaration of priority can be made, rights re-established, and certified copies submitted. You can file a divisional application, and you can request extension and validation in non-contracting states.
3. Wege zum Ziel
Vorgehen beim Durchsetzen von Schutzrechten
There are national, regional (e.g. EPO) and international (WIPO) ways to seek protection, depending on where you need it. International protection under the PCT is administered by WIPO, and you can obtain protection in 159 countries. The PCT request contains these terms: you name an agent or common representative, request to restore priority, choose an International Searching Authority (ISA) and make an array of declarations in relation to:
- the identity of the inventor
- the applicant’s entitlement to apply for and be granted a patent and to claim the priority of an earlier application
- non-prejudicial disclosures or exceptions to lack of novelty
- inventorship (only for the USA: “I hereby acknowledge that any willful false statement made in this declaration is punishable under 18 U.S.C. 1001 by fine or imprisonment of not more than five (5) years, or both“)
You have to pay fees for transmittal, search, international filing, priority document, restoring priority, and earlier search documents.
IV. Marken
Erlangung von Markenschutzrechten
Trade marks (US: trademarks) are signs used to identify products. At the national/regional level, protection can be obtained by filing an application for registration with the national/regional trade mark office. At the international level, you have two options: you can file an application with the trade mark office of each country in which you are seeking protection, or you can use WIPO’s Madrid System to file an international registration for up to 130 countries.
Wofür Patente angemeldet werden
The most common forms in which trade marks are applied for are words (word marks) or images (figurative marks), or combined word/figurative marks. In many countries, you can also protect shapes, sounds, services, positions, patterns, colours, motions, multimedia, and holograms.
Kategorien, Prüfung und Einspruchsfrist
Trade marks are registered for certain classes. The International Classification of Goods and Services for the Purposes of the Registration of Marks (Nice Classification) contains 45 classes (34 for goods and 11 for services), which you can access here. Trade mark registration in the EU involves an examination and an opposition period. Grounds for refusal are examined, and an opposition involves a cooling-off period to give parties a chance to reflect (and settle in one way or another).
V. Weitere Begriffe
Rechte am geistigen Eigentum
IP rights can be protected, abandoned, limited, revoked, and declared invalid. In some jurisdictions, you can bring a nullity action. Some official letters are called Office Action. Depending on the country you are dealing with (e.g. USA, India, Australia), there may be further terms to get familiar with.
Einheitspatent
One of the latest developments in the IP world is the Unitary Patent (or, more precisely, the European patent with unitary effect). It is based on the European patent, but saves you the process of having it validated in several countries by providing a post-grant procedure leading to uniform protection in all participating member states (17 at the moment). Moreover, a dedicated court has been set up to handle validity and infringement matters. Rather than taking action wherever you might have an issue, the Unified Patent Court (UPC) constitutes a single decision-making body.
VI. Durchsetzung
Handlungsmöglichkeiten
Jede Menge Dinge, die wir bei Verletzungen tun bzw. verlangen können:
- stop infringing activities; this usually involves a warning or a cease & desist letter, or even injunctive relief;
- request information about the origins and distribution channels of items, as well as money made (rendering of accounts);
- delivery up, destruction, or recall of products.
Neben der nationalen Gerichtsbarkeit gibt es im Hinblick auf Europäische Patente das Einheitliche Patentgericht (EPG) | Unified Patent Court (UPC).
Zuständiges Gericht und Verfahrenseinleitung
Das EPG entscheidet sowohl über Verletzungs- als auch Nichtigkeitsklagen (infringement/revocation action). Das deutsche Patentstreitsystem hingegen ist zweigeteilt: für Verletzungsklagen ist das Landgericht (Regional Court), für Nichtigkeitsklagen das Bundespatentgericht (Federal Patent Court) zuständig. Hinsichtlich der Terminologie in EPG-Verfahren, bietet es sich an, dessen Verfahrensordnung (Rules of Procedure) zu Rate zu ziehen, die es auf Deutsch und Englisch gibt. Das Verfahren vor dem EPG wird von einem Berichterstatter (judge-rapporteur) geleitet und soll binnen eines Jahres ab Zustellung der Klage an den Beklagten abgeschlossen sein. Zunächst findet ein schriftliches Verfahren statt, in dem jeweils zwei Schriftsätze innerhalb strenger Fristen ausgetauscht werden. Hier unterscheidet die Verfahrensordung (rules of procedure) des EPG:
- statement of claim (Klageschrift)
- statement of defence (Klageerwiderung)
- reply (Replik)
- rejoinder (Duplik)
Ablauf des Verfahrens
Es folgt ein Zwischenverfahren (interim procedure), in dem die mündliche Verhandlung vorbereitet wird. Bei Bedarf kommt es zu einer Zwischenanhörung (interim conference), um wichtige Punkte und offene Fragen zu klären. Danach wird die mündliche Verhandlung (oral hearing) anberaumt und die Parteien hierzu geladen (summoned). Die Verfahrensordnung sieht vor, dass das Urteil „sobald wie möglich“ ergeht und nicht später als sechs Wochen nach der mündlichen Verhandlung schriftlich abgesetzt (issued) wird.
Einstweilige Verfügungen
Einstweilige Verfügungen sind in erster Linie auf eine schnelle Realisierung eines Unterlassungsanspruchs gerichtet, z.B. um eine Einfuhr (import) schutzrechtsverletzender Produkte oder deren Ausstellung (exhibition | presentation) auf einer Messe (fair) zu unterbinden. Eine Anhörung des Antragsgegners kann unterbleiben (ex parte), wenn er zuvor Gelegenheit hatte, Stellung zu nehmen, etwa im Rahmen einer erfolgten Abmahnung (warning letter) oder durch Einreichen einer Schutzschrift (protective brief). Auch spricht eine Vereitelung des Zwecks (defeat the purpose) des Verfügungsverfahrens gegen eine Anhörung.
VII. Amts- oder Mandantenkorrespondenz?
Stil sollte dem Adressaten angepasst werden
Nun noch das leidige Thema des guten Stils. Vielen gelingt es nicht danach zu unterscheiden, wem sie schreiben. Sie verharren bei dem, was sie gewohnt sind. Und das ist meist jener Stil, der von und gegenüber Ämtern, Gerichten und Kollegen gepflegt wird. Sehen wir uns doch mal ein paar Beispiele an:
- You are hereby informed of a notice of opposition.
- You are requested to remedy the deficiencies within two months.
- You are reminded that no appeal may be lodged.
- If any fee due is not paid, the application will be deemed to be withdrawn.
- Attention is drawn to the attached text.
Amtskorrespondenz
Amtskorrespondenz (in diesem Fall von unserem geliebten EPA). Gekennzeichnet durch das Passiv und Fachbegriffe. Wollen wir genau so unseren Mandanten begegnen? Sind diese Ämter, Gerichte oder Kollegen? Natürlich nicht. Ganz selten sind sie vom Fach. Wir haben es eher mit Unternehmern, Managern und Ingenieuren zu tun. Dementsprechend tun wir gut daran, ein Wirtschaftsenglisch an den Tag zu legen, das auf abgedroschene und verklausulierte Formulierungen verzichtet und das beherzigt, was wir (hoffentlich) als Business Communication begreifen, nämlich höflich und verständlich zu formulieren. Dazu gehört, das Passiv nach Möglichkeit zu umschiffen, weil es schlicht und ergreifend hässlich ist. Dazu gehört auch, Fachbegriffe nur dort zu verwenden, wo es sein muss. Feststehende Begriffe wie etwa Einspruch und Beschwerde braucht man, aber ein Wort wie deem (das nur Juristen benutzen) kann man auch durch consider order regard as ersetzen. Vergleichen Sie:

Was glauben Sie, was besser klingt: links oder rechts? Natürlich rechts! Nehmen wir uns noch einen typischen Satz aus den Anfängen eines Mandats vor:
| In vorbezeichneter Angelegenheit bedanken wir uns für die Erteilung des Mandats. |
Klingt doch ziemlich wortgetreu oder? Ist aber grausam. Sehr wörtlich, sehr förmlich, und am Ende auch noch falsch. Denn das deutsche Wort Mandat geht nicht im englischen Wort mandate auf. Vielmehr sprechen wir von case oder matter. Machen wir es lieber so:
Thank you for instructing us in the above matter.
Tipps
Grundsätzlich kann es bei der Mandantenkorrespondenz helfen,
- das Passiv zu vermeiden und im Aktiv zu formulieren: so wird aus be informed/invited/requested inform/invite/request;
- von altmodischen und sehr förmlichen Begriffen Abstand zu nehmen: so wird aus aforementioned oder above-mentioned schlicht above;
- in Höflichkeitsformen zu baden und viel thank you, please, would, could, may, appreciate, sorry und ähnliches zu verwenden.
Also immer schön unterscheiden.
